Privacy policy for website visitors and users of MP services

The web site www.mladipodjetnik.si is managed by the Zavod mladi podjetnik, Kunaverjeva 9, 1000 Ljubljana (hereinafter: MP, also the “us” derivatives).

This Privacy Policy explains in detail how we use the personal information you provide to us when using the website and when ordering the services provided by the MP.

1. What is personal information?

Personal information is information that directly or indirectly identifies you as an individual, and “indirectly” means in combination with other information, for example: with your name, postal address, email address, phone number, identification number, location data or other identifiers.

2. What kind of personal information do we collect?

If you are only a visitor of the MP website, we collect data using only cookies. If you are a MP service user (for example: you signed up for an event organized by the MP), we also collect other personal information that we need to provide the services you have ordered. These personal data are:

  • name and surname;
  • contact email address;
  • username;
  • contact telephone;
  • IP address;
  • invoice information (name and surname, address and postal code and tax number of the legal person).

3. How do we use (process) your personal information?

All forthcoming personal data are treated confidentially and are used only for the purpose for which they were forthcoming. MP has a very serious approach to data security. We use an appropriate level of protection and we have established reasonable physical, electronic and administrative measures to protect the collected data against unintentional or unlawful destruction, loss, alteration, unauthorized disclosure of personal data or unauthorized access to personal data that has been downloaded, stored or otherwise treated. Our rule books and procedures for protecting information are closely linked to widely accepted international standards and are regularly checked and, if necessary, updated to comply with our business needs, changes in technology and regulatory requirements. Access to your personal information is permitted only to staff, service providers who need this information for business reasons (business “need-to-know”) or those who need them for doing their work.

In case of a violation of personal data protection, the MP will follow all relevant data violation regulations.

If you have ordered a MP service, personal data are collected and processed for the conclusion and implementation of the contract, i.e. to provide subscribed services and to inform about additional details of such services, any changes, additional details, instructions for using the services or to pass working materials for MP services of an educational character.

In case of an order for a paid service based on tax regulations for the proper issue of an account, we also extract and process your address and tax number of legal person and privat entrepreneurs.

In case of an order for MP e-newsletter (ie newsletter), your forwarded e-mail address and name based on consensus are processed with the purpose of general information about all MP services and summaries of news, articles and education published on the MP website.

You can unsubscribe at any time from receiving e-news or from informing about ordered MP service by clicking on the link in the received messages or by contacting us at info@mladipodjetnik.si.

When you register on our forum (forum.mladipodjetnik.si), we obtain and process your email address for registration and identity verification purpose or to create your user profile you use to access our forum. We delete your user profile along with your email address when you deactivate it or delete your user profile.

The MP binds not to sell, lend or otherwise transfer information that you will provide through websites or by any other means to third parties, except in the cases listed below and unless otherwise prescribed by law.

Your personal information will be unveiled to the third parties by MP only under the conditions set out below, and the MP will ensure that your personal data will be processed, protected and transferred in accordance with the valid regulations:

External service providers

If necessary we will authorize other companies and individuals to perform certain works that contribute to our services. For example, personal data may be provided to providers for hosting our databases and applications, for data processing services, or for sending the information you requested for providing support services, etc. External service providers will provide such data or make them accessible only to the extent required by a specific purpose. These data will not be used for any other purpose. External service providers MP are contractually bound to respect the confidentiality of your personal information.

Business transfers

In connection with any reorganization, status conversion, sale or any other transfer of funds (commonly referred to as “business transfers”), we will transfer the data to a reasonable extent and as necessary for the business transfer, provided that the receiving party undertakes to respecting your personal data in accordance with the applicable personal data protection rules. We will continue to ensure the confidentiality of all personal data and inform the affected users before personal data becomes the subject of another privacy policy.

Public authorities

We will only disclose your personal information to public authorities only in cases where this is required by national law or European Union law. MP will, for example, respond to requests from courts, law enforcement and other state authorities, which may also involve the state authorities of another EU Member State.

4. Legitimate interest

On the basis of legitimate interest, we use your personal information to detect and prevent fraudulent use and misuse of services or subscriptions to them; furthermore, in the context of ensuring the stable operation of our system and services as well as for the purpose of implementing information security measures, meeting the requirements regarding quality of services and discovering technical system and service failure.

On the basis of legitimate interest, we use your personal information also for the purposes of possible enforcement, judicial and extrajudicial recovery.

5. Your rights regarding your personal information

Individuals may request access to personal data, correction, deletion or restriction of the processing of your personal information by the MP, and you have the right to object to the processing and transferability of your personal information.

The right to be informed: You are always entitled to know whether personal data is processed in relation to you and, if so, access to your personal information and the following information: (a) treatment purposes; (b) the nature of the personal data concerned; (c) the users or categories of users to whom personal data have been or will be disclosed; (d) the estimated period of retention of personal data or, if that is not possible, the criteria used to determine that period; (e) where personal data does not collect from you all available information regarding their source.

The right to a correction: you have the right to correct inaccurate personal information relating to you and taking into account the purposes of the processing, the right to supplement incomplete personal data.

Right of deletion: You have the right to delete your personal information when one of the following reasons applies:

(a) personal data are no longer necessary for the purposes for which they were collected or otherwise processed; (b) when you revoke the consent on the basis of which the processing takes place and where no other legal basis exists for processing; (c) where you object to the processing and there are no overriding legitimate reasons for processing them; (d) personal data has been processed unlawfully.

Right to Restrict Processing: You have the right to limit the processing of your personal information when one of the following is true:

(a) when disputing the accuracy of the data, for a period allowing us to verify the accuracy of personal data; (b) the processing is illegal and you are opposed to the deletion of personal data and, instead, requires a restriction on their use; (c) We do not need your personal information anymore for processing purposes, but you need them to enforce, enforce or defend legal claims; (d) if you have lodged an objection concerning treatment based on MP’s legitimate interests until it is verified that our legitimate reasons are over your reasons.

Where processing of your personal data has been restricted in accordance with the preceding paragraph, such personal data, with the exception of their storage, shall be processed only with your consent or for the enforcement, enforcement or defense of legal claims or for the protection of the rights of another natural or legal person.

Before canceling the processing limit of your personal information, we are obliged to inform you of this.

The right to data transferability: You have the right to receive your personal information that you have provided us in a structured, widely used and machine-readable form, and the right to forward this information to another controller when the processing is based on your consent or the processing is performed with automated means. At your request, where technically feasible, personal data may be transferred directly to another controller.

Right to file a complaint with the Information Commissioner: if we do not decide on your request within the legal deadline or if we reject your request, you have the possibility to file a complaint with the Information Commissioner.

6. Access and correction of your personal information and the exercise of other rights

As a user of the MP website you have the right to check whether the MP is processing personal information about you and accessing personal information that we keep about or about you. We process (in this case, we will forward them to you as a PDF document that is machine-readable). You can always request that inaccurate personal information be corrected. If you think that there is no longer any justified reason for further use, We will notify you of processing your personal information, but certain personal data collected under the Value Added Tax Act should not be deleted. You also have the right to limit the use of your personal information in cases where you accuse the accuracy of personal information when you judge that the processing is illegal but you do not want to delete it, and when personal data is no longer necessary for the purpose of processing you need them to enforce legal claims. In the case of an e-newsletter, you have the right to object to the processing of your personal information

For the possible exercise of our rights described, please send us your request in writing, via e-mail to info@mladipodjetnik.si (Borut Borštnik and Egon Ravbar). The responsible person will respond to your request within the prescribed deadline of 1 month. In case of complexity and a greater number of requests, the deadline may be extended by up to two additional months, which you will be informed of.

7. Storage

The MP stores the personal information that it has received from you until e-news is removed (withdrawal of consent). Once a year, MP revises existing subscribers to e-news, and if you have not opened it for a long time, read any of your newsletters we will send you an email to renew your consent (e-newsletter subscription) with a 14-day deadline, otherwise we will delete your personal information and stop sending you e-news.

MP keeps data relating to the services provided one month after the end of the service. After that time, we delete them if the law does not specify otherwise. On the basis of the provisions of tax regulations, for example, The MP is obliged to store the accounts on which the personal data of the client of the MP service are still 10 years after the service has been provided.

MP will also not delete the information it needs to provide proof that it has erased information about the person (i.e., the audit trail), and to keep records of persons who do not want the MP to contact them in the future. These data are the email address and the first and last name.

8. Cookies

MP on the site uses “cookies” – these are small files that are saved on your computer when you visit a site. Cookies can help you make further page visits. With the settings in your browser, you can decide whether or not to accept “cookies”.
